These Terms of Service (the "Terms") govern your use of ScamScan (the "App"). Please read these Terms carefully before downloading or using the App. By downloading or using the App, you agree to be bound by these Terms.
These Terms apply to all users of App. By downloading or using App, you are deemed to have agreed to all provisions of these Terms.
You acknowledge that this agreement is concluded between Company (or developer) and End-User only, and not with Apple. This agreement is regarding the licensed application and its content for which Company is solely responsible.
Company shall be solely responsible for providing any maintenance and support services with respect to the licensed application, as specified in these Terms, or as required under applicable law. You and End-User acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the licensed application.
The App may modify these Terms at any time as deemed necessary. Modified Terms shall become effective upon posting within the App or on the website. Continued use of the App after modifications shall constitute acceptance of the modified Terms.
In case of significant changes, users may be notified within the App or through other appropriate means.
A non-exclusive, non-transferable license to use the App is granted. Users are prohibited from engaging in the following activities:
Note that if the App contains open-source components, the license terms of those components may take precedence.
Users must not engage in the following activities when using the App.
If it is determined that any of the above provisions have been violated, the App reserves the right to suspend service provision to the user or delete the account. Additionally, damages may be sought if losses occur due to these violations.
The App is provided for the purpose of analyzing scam messages. Users can input messages or images and obtain scam probability analysis results via AI.
Input messages and images are sent to an external AI analysis API, and scam probability is determined. Analysis results are for reference only and do not guarantee 100% accuracy.
Analysis history and user settings are saved in local storage within the device. These data are not saved to the cloud and are managed only on the user's device. For details, please refer to the Privacy Policy.
The App is intended for use by persons 13 years or older. Minors should use the App only with parental consent.
You acknowledge that Company, not Apple, is solely responsible for addressing any claims of End-User or any third party relating to the licensed application or End-User's possession and/or use of that licensed application, including, but not limited to: (i) product liability claims; (ii) any claim that the licensed application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with Your licensed application's use of HealthKit and HomeKit frameworks.
These Terms do not limit Company's liability to End-User beyond what is permitted by applicable law.
The App is provided "AS IS" without any warranty whatsoever regarding the App's features, performance, or quality.
Furthermore, the App assumes no liability for any damages resulting from the App's analysis results. The final decision should be made by the user.
Except in cases of intentional or gross negligence on the part of the Company (or developer), the maximum liability for damages that the Company assumes in connection with this Service shall be the total amount of usage fees that the User has paid to the Service in the immediately preceding three months (if said amount is less than JPY 1,000, then JPY 1,000).
However, the Company assumes no liability for the following damages, even if foreseeable:

End-User represents and warrants that (i) he/she is not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) he/she is not listed on any U.S. Government list of prohibited or restricted parties.
End-User must comply with applicable third party terms of agreement when using Your Application, e.g., if You have a VoIP application, then End-User must not be in violation of their wireless data service agreement when using Your Application.
Note that currently there are no third-party services (such as VoIP) used in this application. If third-party services are added in the future, End-Users will be notified.
You and End-User acknowledge and agree that Apple, and Apple's subsidiaries, are third party beneficiaries of these Terms, and that, upon End-User's acceptance of the terms and conditions of these Terms, Apple will have the right (and shall be deemed to have accepted right) to enforce these Terms against End-User as a third party beneficiary thereof.
Any and all disputes regarding this Service shall have Tokyo District Court as the exclusive court of first instance in agreed jurisdiction.
Users may stop using the App or delete their account at any time. Account deletion can be performed from the settings screen.
Additionally, the App reserves the right to terminate or suspend App provision without prior notice. However, in such cases, users shall be notified within a reasonable scope.
All intellectual property rights (copyright, trademark rights, patent rights, utility model rights, design rights, etc.) regarding the App belong to the Company or legitimate rights holders.
Users may use analysis results obtained through the App only within the scope of personal use.
If any provision of these Terms is deemed invalid, such provision shall remain in full force and effect to the extent possible without affecting the validity or enforceability of other provisions, and shall be modified to the extent necessary to achieve the original intent.
The App shall not be deemed to have waived any provisions not expressly agreed upon between the user and the Company.
